Terms of Service

The rules for using ToInbox. Please read carefully.

1. Agreement

These Terms of Service ("Terms") govern your access to and use of ToInbox, including the Chrome extension, the marketing website at toinbox.app, and the application at app.toinbox.app (together, the "Service"). The Service is operated by TopFounder, a sole proprietorship of Devansh Karnani ("we", "our", "us"), with registered address at 134 Salkia School Road, Howrah, West Bengal 711106, India.

By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You may use ToInbox only if:

• You are at least 16 years old, or the age of digital consent in your jurisdiction (whichever is higher), and have the legal capacity to enter into a contract.
• You have a LinkedIn account and a Gmail (or Google Workspace) account that you control.
• You are not barred from receiving services under applicable law.

3. What the Service does

ToInbox helps you send personalized cold emails to founders of companies listing roles on LinkedIn. When you enroll a job, the Service:

1. Looks up the company's founder via third-party databases (e.g. Apollo).
2. Uses an AI service to draft a personalized email based on your resume and the job description.
3. Sends that email from your Gmail account, with your resume attached.
4. Watches the same Gmail thread for replies and surfaces them on your dashboard.

You are always the legal sender of any email the Service sends from your Gmail account. We are a tool you direct.

4. Acceptable use

You agree NOT to use the Service to:

• Send unsolicited bulk email (spam), phishing messages, or any communication that violates anti-spam laws (including CAN-SPAM, CASL, GDPR e-Privacy, India's IT Rules, or equivalent laws in your jurisdiction).
• Impersonate another person, misrepresent your identity, or use a resume that is not yours.
• Target minors, vulnerable individuals, or anyone who has asked you not to contact them.
• Send threatening, harassing, hateful, defamatory, sexually explicit, or otherwise unlawful content.
• Attempt to scrape, reverse-engineer, decompile, or interfere with the Service or its infrastructure.
• Resell, rent, sublicense, or commercialize the Service or any portion of it without our written permission.
• Bypass usage limits, rate limits, or sending caps by creating multiple accounts.
• Use the Service to compete with or build a substantially similar product.

6. Your account and security

You are responsible for maintaining the security of your LinkedIn and Gmail credentials, your ToInbox account, and any device used to access the Service. Notify us promptly at support@topfounder.io if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe have been compromised.

7. Your content

You retain all ownership rights to the content you provide (your resume, your profile details, the emails the Service generates and sends on your behalf). By using the Service you grant us a limited, non-exclusive, royalty-free, worldwide license to process that content solely for the purpose of operating the Service for you. This license terminates when you delete the relevant content or your account.

You represent that you have the right to provide the content you upload, that it is accurate, and that its use by the Service will not infringe any third-party rights or violate any law.

8. Pricing & plans

A "send" is one outbound application email generated and dispatched through the Service. Replies, follow-ups within an existing thread, and failed attempts do not count against your send quota.

Paid plans renew monthly on the day of original subscription unless cancelled. Prices are in Indian Rupees (INR) and inclusive of applicable indirect taxes unless stated otherwise. We may change prices on at least 14 days' notice; price changes do not affect the current billing cycle. Unused sends do not roll over to the next month.

8.1 Refunds and cancellation

You may cancel your paid plan at any time from your account; cancellation takes effect at the end of the current billing period. Because the Service is delivered immediately on payment, we generally do not provide refunds for partial months or unused sends. If you believe you were charged in error, contact support@topfounder.io within 7 days of the charge and we will review your request in good faith.

9. Intellectual property

The Service, including its software, design, copy, and brand, is owned by TopFounder and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal job-search use, subject to these Terms. No other rights are granted.

10. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if:

• You violate these Terms or our Privacy Policy;
• Your use threatens the security or integrity of the Service;
• Your use creates risk or legal exposure for us, including under LinkedIn's or Google's policies;
• You fail to pay applicable fees;
• We are required to do so by law.

You may stop using the Service at any time by disconnecting your accounts and emailing support@topfounder.io to request deletion. On termination, sections 4, 7 (your warranties), 9, 11–14 survive.

11. Disclaimers — no warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-generated content, the success rate of applications, or that you will receive interview calls. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that founder emails returned by third-party lookups will be current or accurate.

12. Limitation of liability

To the maximum extent permitted by law, in no event shall TopFounder, its owner, or its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, business, opportunity, goodwill, or LinkedIn/Gmail account access, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.

Our aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) ₹2,000. Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.

13. Indemnification

You agree to indemnify and hold harmless TopFounder, its owner, and its affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of (i) your use of the Service, (ii) your content, (iii) your violation of these Terms or applicable law, or (iv) your violation of any third party's rights, including LinkedIn's or Google's terms.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. Nothing in this section affects any non-waivable consumer-protection rights you may have under the laws of your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version. Material changes will be highlighted in-app or by email where appropriate. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you do not agree to the changes, stop using the Service.

16. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede prior agreements.
• Severability. If any provision is found unenforceable, the remainder remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of our business.
• Notices. We may send notices to the email associated with your account; you should send notices to support@topfounder.io.
